GENERAL CONDITIONS FOR THE PROVISION OF MOBILE AND LANDLINE TELEPHONE SERVICES I.P.<\/h2>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
\n\t\t\t\t
\n\t\t\t

Purpose: SNRG AMERICAN COMPUTER SOLUTIONS LLC.,<\/strong> will provide the customer with the mobile and fixed communications service I.P., including electronic communications services in the contract for particular contracts of mobile and fixed line service I.P.<\/p>\n

\n Secrecy of communications and integrity and security of networks and services: SNRG AMERICAN COMPUTER SOLUTIONS LLC.<\/strong> has adopted the necessary technical means at all times to protect the secrecy of communications. SNRG AMERICAN COMPUTER SOLUTIONS LLC.<\/strong> shall be exonerated from any liability that may arise from the obtaining by the Client or by third parties of recordings of telephone conversations, their use or advertising and, in general, from any actions and omissions, not attributable to and beyond the control of SNRG AMERICAN COMPUTER SOLUTIONS LLC.,<\/strong> THAT VIOLATE THE CONFIDENTIALITY AND SECRECY OF TELEPHONE COMMUNICATIONS. SNRG AMERICAN COMPUTER SOLUTIONS LLC.<\/strong> will adopt the technical measures admitted by current legislation, in order to maintain the integrity of the networks as well as to ensure their security against any unauthorized access. <\/p>\n

Terminals:<\/strong> Models of terminals (Smartphones), as well as i.p. landline telephones that have the corresponding certificate of acceptance, issued by the body designated for this purpose by the Public Administration, may be connected to the telephone service available to the public.<\/p>\n

Start of the service and duration: SNRG AMERICAN COMPUTER SOLUTIONS LLC.<\/strong> undertakes to initiate or reject the provision of the service within a maximum period of 15 working days from the date of formalization of this contract, its duration being indefinite without prejudice to the provisions of the following clause of \"interrupted interruption of the service\"<\/p>\n

Price: SNRG AMERICAN COMPUTER SOLUTIONS LLC.<\/strong> will apply the current prices for the contracted modality. These economic conditions will be provided to the client at the time of contracting. Likewise, the prices of SNRG AMERICAN COMPUTER SOLUTIONS LLC.<\/strong> are available, perfectly updated for consultation on the website WWW.SNRGSOLUTIONS.NET<\/p>\n

Billing: SNRG AMERICAN COMPUTER SOLUTIONS LLC.<\/strong> will bill the client on a monthly basis in 6-month or yearly installments, given that payment for the contract is computed on a semi-annual or annual basis<\/p>\n

SNRG AMERICAN COMPUTER SOLUTIONS LLC.<\/strong> will issue an invoice for the service contracted by the customer<\/p>\n

Right to disconnect:<\/strong> The customer has the right to request the company to disconnect the telephone services accepted in the contract of particular conditions of mobile line service, through the website WWW.SNRGSOLUTIONS.NET SNRG AMERICAN COMPUTER SOLUTIONS LLC.<\/strong> will carry out such disconnection in an automated way through the website. Once the payment for the contracting of the services has been made (semi-annual payment in advance), said request for disconnection at the request of the customer will not accrue any proration corresponding to the refund of the total amount of the semester.<\/p>\n

Temporary suspension of service:<\/strong> In the event of non-payment, SNRG AMERICAN COMPUTER SOLUTIONS LLC.<\/strong> may suspend the unpaid service from the date on which it becomes aware of such circumstance. SNRG AMERICAN COMPUTER SOLUTIONS LLC.<\/strong> may suspend the provision of telephone service in the event of fraud or circumstances that objectively lead to the presumption of unlawful use of the service.<\/p>\n

Definitive interruption of service: This contract will be terminated, with the consequent definitive interruption of the service, for the general reasons admitted by law and, especially, for the following: \n

    \n
  1. By decision of the client, communicated to SNRG AMERICAN COMPUTER SOLUTIONS LLC.,<\/strong> AT LEAST 15 DAYS BEFORE THE DATE OF TERMINATION. The CLIENT may exercise his right to terminate the contract in the same manner as he entered into it.<\/li>\n
  2. For serious breach of the obligations arising from this contract, as well as for the use of the service, good faith or commonly accepted practices would count as correct use in mobile telephony services.<\/li>\n
  3. For non-payment of the six-monthly automatic renewal for a period of 15 days of administrative grace.<\/li>\n
  4. For illicit or improper use of the service that entails the use of the condition of customer status to carry out a business, professional or economic activity whose objective is the assignment or resale of the SNRG AMERICAN COMPUTER SOLUTIONS LLC. service.<\/li>\n <\/ol>\n <\/p>\n

    SNRG AMERICAN COMPUTER SOLUTIONS LLC.<\/strong> will apply the best technical and procedural advances to ensure the highest quality at all times in all communications subject to the service.<\/p>\n

      \n
    1. In the event of a temporary interruption of the service attributable to SNRG AMERICAN COMPUTER SOLUTIONS LLC.<\/strong> , the CLIENT will be entitled to automatic compensation (provided that it is greater than \u20ac1), the amount of which will be equal to the monthly premium for the days of non-working service.<\/li>\n
    2. \n In interruptions due to force majeure, SNRG AMERICAN COMPUTER SOLUTIONS LLC.<\/strong> will automatically compensate the subscriber with the refund of the amount prorated based on the monthly fee, for the days of non-business service. The compensation will be made through a discount on the invoice. On the invoice corresponding to the next renewal of services. If there is no such renewal, a refund will be made to the account stipulated by the customer to make their corresponding payments for the telephone service provided. <\/li>\n
    3. The provisions of the previous sections will not apply when the temporary interruption is motivated by any of the following causes: 1.- Serious breach by customers of the contractual conditions, especially in the event of fraud or delay in payment that will lead to the application of the temporary suspension and interruption of the service. 2.- Damage caused to the network (the customer's network provider) due to the connection by the customer of terminal equipment whose conformity has not been assessed, in accordance with current regulations. 3.- Failure to comply with the code of conduct by a charging service provider (the customer's network supplier) when the ownership of the subscription contract corresponds to the latter.<\/li>\n <\/ol>\n

      Data protection: SNRG AMERICAN COMPUTER SOLUTIONS LLC.<\/strong> informs that the data of its customers will be treated in accordance with the privacy policy of SNRG AMERICAN COMPUTER SOLUTIONS LLC.,<\/strong> IN ACCORDANCE WITH THE REGULATIONS OF THE COMPANY'S LEGAL HEADQUARTERS.<\/p>\n

      At SNRG AMERICAN COMPUTER SOLUTIONS LLC.<\/strong> we will process the client's personal data for the provision of the service, as well as for other purposes that as a client SNRG AMERICAN COMPUTER SOLUTIONS LLC.,<\/strong> allows or authorizes us under the terms set out in the privacy policy, which also includes all the information necessary for the CLIENT to decide on other processing that requires their consent.'<\/p>\n

      Notifications:<\/strong> The notifications that the CLIENT must make to SNRG AMERICAN COMPUTER SOLUTIONS LLC.<\/strong> due to the provisions of this contract and in execution of the same, will be made through the email designated for this purpose.<\/p>\n

      \n Notices and communications by SNRG AMERICAN COMPUTER SOLUTIONS LLC.<\/strong> to CLIENT shall be made as follows:

        \n
      1. Sending by email, whenever possible, to any of the email addresses that the CLIENT provides to SNRG AMERICAN COMPUTER SOLUTIONS LLC.<\/strong> for such purposes.<\/li>\n
      2. Communication through the CLIENT's private area SNRG AMERICAN COMPUTER SOLUTIONS LLC.<\/strong> , which can be accessed through the website www.snrgsolutions.net the names that replace them.<\/li>\n <\/ol>\n <\/p>\n

        In this regard, the CLIENT declares that all the data provided by him is true and correct, and undertakes to notify SNRG AMERICAN COMPUTER SOLUTIONS LLC.<\/strong> of any variations that, if any, may occur in his data, or in any other address or means of contact, in the collection data, as well as in any other type of information necessary for the management and maintenance of the contractual relationship between SNRG AMERICAN COMPUTER SOLUTIONS LLC.<\/strong> and the CLIENT.<\/p>\n

        Contractual modification.<\/strong> The CLIENT undertakes to notify SNRG AMERICAN COMPUTER SOLUTIONS LLC.<\/strong> of any change in the details of the contract, especially the billing address and the method of payment.<\/p>\n

        \n SNRG AMERICAN COMPUTER SOLUTIONS LLC.,<\/strong> FOR THE SOLE PURPOSE OF RESTORING THE BALANCE OF THE SERVICES BETWEEN THE PARTIES, MAY MODIFY THE CONDITIONS ESTABLISHED IN THE CONTRACT AND IN PARTICULAR THE PRICE OF THE SAME, FOR ANY OF THE FOLLOWING REASONS WHEN THEY ARE DUE TO SITUATIONS THAT OCCURRED AT A TIME AFTER THE SETTING OF THE SERVICE RATES BY SNRG AMERICAN COMPUTER SOLUTIONS LLC<\/strong>:

          \n
        • Increase in the costs of the business sector in which SNRG AMERICAN COMPUTER SOLUTIONS LLC.<\/strong> is present and that result in coverage, network quality or service characteristics.<\/li>\n
        • Regulatory modifications (including taxes, fees or administrative or judicial resolutions) that affect the conditions of provision of the service.<\/li>\n
        • Increase in the consumer price index (CPI) or, failing that, the industrial price index (IPRI)<\/li>\n <\/ul>\n <\/p>\n

          SNRG AMERICAN COMPUTER SOLUTIONS LLC informs the CLIENT of any modification with an indication of the precise reason to which it is due at least 1 month before the date on which the modification will be effective, with the CLIENT having the right to terminate the contract (once the contracted six-month period has ended) without any economic damage. If one month has elapsed since the notification and SNRG AMERICAN COMPUTER SOLUTIONS LLC has not received notification to the contrary, it will be understood that the CLIENT accepts the modifications.<\/strong><\/p>\n

          Claims:<\/strong> Without prejudice to other legal actions provided for by law, complaints about the operation of the services, rates, billing, quality or any other issue that may arise in relation to the provision of the service, may be addressed to SNRG AMERICAN COMPUTER SOLUTIONS LLC.,<\/strong> THROUGH THE CORRESPONDING MAIL OR IN www.snrgsolutions.net WITHIN A PERIOD OF ONE MONTH FROM THE MOMENT THE FACT OR CAUSE THAT MOTIVATES THE CLAIM IS KNOWN. without prejudice to those cases in which the current regulations establish other deadlines for this. In certain circumstances, and for the best resolution of these, SNRG AMERICAN COMPUTER SOLUTIONS LLC.<\/strong> may offer the customer to submit the complaint in writing. At the same time as the complaint is made, the customer will be provided with the reference number of the complaint and, in addition, may request a document that proves the presentation and content of the complaint.<\/p>\n

            \n
          1. Permanence commitment<\/strong>, given that the amount of the monthly installments are paid in advance, there is no permanence commitment, but the termination of the contract must be communicated by email to this effect.<\/li>\n <\/ol>\n

            Any concept or stipulation exempt from these general terms and conditions for the provision of services will be subject to commercial law and the courts of the place where the legal\/tax domicile of SNRG AMERICAN COMPUTER SOLUTIONS LLC.<\/strong> resides<\/p>\t\t
